1. About us
These terms apply to services provided by Home Automation Bath, a smart home installation company based in Bath, Somerset, UK. By accepting a quotation or commissioning work from us, you agree to these terms.
References to "we", "us", and "our" mean Home Automation Bath. References to "you" and "your" mean the client commissioning the work.
2. Our services
We design, supply, and install smart home systems including but not limited to: smart lighting, automated heating, security and CCTV, home cinema and AV, motorised window treatments, structured networking, multi-room audio, and whole-home integration.
All services are carried out by our own engineers or trusted, vetted subcontractors working to our standards. We do not undertake electrical installation work that requires certification by an approved electrician unless working in partnership with one.
3. Quotations
Initial consultations are free of charge and carry no obligation. All written quotations are valid for 30 days from the date of issue unless otherwise stated. Prices in quotations are subject to change after this period due to hardware pricing fluctuations.
Quotations are based on the information available at the time. If, upon commencing work, we discover conditions that materially change the scope (for example, inaccessible wall cavities, undisclosed asbestos, or structural constraints), we will advise you promptly and agree any additional cost in writing before proceeding.
4. Acceptance and commencement
Work begins only upon written acceptance of a quotation by you, typically via email or signed quotation. Verbal agreements are not binding.
For projects involving the supply of hardware, a deposit (typically 50% of the hardware cost, or an agreed amount) is required before materials are ordered. Remaining payment is due on completion of the installation unless staged payments have been agreed in writing.
For smaller, labour-only works, full payment is due within 7 days of completion.
5. Changes to scope
Any changes to the agreed scope of work after acceptance of a quotation must be agreed in writing. Additional work requested during installation will be assessed and quoted at the time; work will only proceed with your written agreement.
6. Your obligations
You agree to provide safe, reasonable access to the property at agreed times. Where work is being carried out during a building project, you are responsible for co-ordinating access with other trades. Delays caused by restricted access may result in additional charges.
You are responsible for ensuring the property has adequate power supply and, where applicable, an internet connection capable of supporting the installed systems.
7. Warranty
We provide a 12-month warranty on our installation workmanship from the date of completion. This covers defects caused by our installation but does not cover damage caused by third parties, misuse, or fair wear and tear.
Hardware is covered by the relevant manufacturer's warranty, which we will pass through to you. Manufacturer warranties vary by product and are typically between 1 and 5 years. We will assist you in making warranty claims on hardware where we are the registered installer.
8. Our liability
Our liability for any claim arising from our services is limited to the value of the contracted works. We are not liable for:
- Indirect or consequential losses (for example, loss of business, loss of data, or loss of enjoyment)
- Losses arising from circumstances beyond our reasonable control
- Damage caused by pre-existing defects in the property's electrical, network, or structural condition that were not disclosed to us
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.
9. Cancellation
You may cancel a booked installation by giving us at least 5 working days' written notice at no charge. Cancellations with less than 5 working days' notice may incur a fee to cover preparation costs. If hardware has already been ordered, we reserve the right to charge for non-returnable items.
10. Disputes
We always aim to resolve any disputes amicably. If you have a concern about the quality of our work, please contact us as soon as possible and we will investigate and, where appropriate, remedy the issue at no charge.
If a dispute cannot be resolved directly, both parties agree to attempt mediation before pursuing legal action.
11. Governing law
These terms are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
